Throughout the site the following terminology applies to these Terms and Conditions, Privacy Statement, and any or all agreements: the terms "Client", "You", and "Your" refers to you, the person accessing this service and accepting the Company's terms and conditions. "The Company", "Ourselves", "We", "Our", and "Us" refers to our Company. "Party", "Parties", or "Us" refers to both the Client and ourselves, or either the Client or ourselves. TRUCKINZY offers this website, including all , tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
Your access and use of the Services constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and TRUCKINZY. If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede prior agreements or arrangements with you. TRUCKINZY may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason.
By visiting our site and/ or Take services from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

TRUCKINZY may provide to a claims processor or an insurer any necessary information (including your contact information) if there is a complaint, dispute or conflict, which may include an accident, involving you and a Third Party Provider (including a transportation network company driver) and such information or data is necessary to resolve the complaint, dispute or conflict.
These Terms of Use are subject to modifications. We reserve the right to modify or change these Terms of Use and other Truckinzy policies at any time by posting modified documents on the Platform and notifying you of the same for your perusal. You shall be liable to update yourself of such changes, if any, by accessing the same. You shall, at all times, be responsible for regularly reviewing the Terms of Use and the other Truckinzy policies and note the changes made on the Platform. Your continued usage of the Services after any change is posted constitutes your acceptance of the amended Terms of Use and other Truckinzy policies. As long as you comply with these Terms of Use, Truckinzy grants you a personal, non-exclusive, non-transferable, limited privilege to access, enter, and use the Platform. By accepting these Terms of Use, you also accept and agree to be bound by the other terms and conditions and Truckinzy policies (including but not limited to Cancellation & Refund Policy. Privacy Policy and Notice and Take Down Policy) as may be posted on the Platform from time to time.
Offers services for drivers and truck owners, by using our services, you agree to abide by the terms and conditions outlined herein.
The Services constitute a technology platform that enables users of TRUCKINZY mobile applications or websites provided as part of the Services (each, an “Application”) to arrange and schedule transportation and/or logistics services with independent third-party providers of such services, including independent third-party transportation providers and independent third-party logistics providers under agreement with TRUCKINZY or certain of TRUCKINZY affiliates (“Third Party Providers”). Unless otherwise agreed by TRUCKINZY in a separate written agreement with you, the Services are made available solely for your personal, non-commercial use.
As a third-party service provider, TRUCKINZY is responsible for facilitating transactions between drivers, truck owners, and other parties. We are not responsible for the actions or behavior of any users of our platform.
Users of our platform, including drivers and truck owners, are responsible for ensuring the accuracy of any information provided and for complying with all applicable laws and regulations. By using our website, truck drivers and owners consent to the sharing of their data with us for the purpose of facilitating employment opportunities and enhancing efficiency in the transportation industry.
Scope of Data: The data shared may include personal information, driving records, certifications, performance metrics, and any other relevant information necessary for the evaluation of potential employment opportunities.
You agree, undertake and confirm that your use of Platform shall be strictly governed by the following binding principles :
You shall not host, display, upload, download, modify, publish, transmit, update or share any information which:
You may access the Platform by registering to create an account ("Truckinzy Account"); or you can also register to join by logging into your account with certain third party social networking sites ("SNS") (including, but not limited to, Facebook); each such account, a "Third Party Account", via our Platform, as described below. The Membership is limited for the purpose and are subject to the terms, and strictly not transferable. As part of the functionality of the Platform services, you may link your Truckinzy Account with Third Party Accounts, by either providing your Third Party Account login information to us through the Platform; or allowing us to access your Third Party Account, as is permitted under the applicable terms and conditions that govern your use of each Third Party Account You represent that you are entitled to disclose your Third Party Account login information to us and/or grant us access to your Third Party Account (including, but not limited to, for use for the purposes described herein), without breach by you of any of the terms and conditions that govern your use of the applicable Third Party Account and without obligating us to pay any fees or making us subject to any usage limitations imposed by such third party service providers.
By granting us access to any Third Party Accounts, you understand that we will access, make available and store (if applicable) any content or information that you have provided to and stored in your Third Party Account ("SNS Content") so that it is available on and through the Platform via your Truckinzy Account.
Unless otherwise specified in these Terms of Use, all SNS Content, if any, will be considered to be your content for all purposes of these Terms of Use.
Depending on the Third Party Accounts, you choose, and subject to the privacy settings that you have set in such Third Party Accounts, personally identifiable information that you post to your Third Party Accounts will be available on and through your Truckinzy Account on the Platform ,Please note that if a Third Party Account or associated service becomes unavailable or our access to such Third Party Account is terminated by the third party service provider, then SNS Content will no longer be available on and through the Platform.
We will create your Truckinzy Account for your use of the Platform services based upon the personal information you provide to us or that we obtain via SNS, as described above. You can only have one Truckinzy Account and are not permitted to create multiple accounts Truckinzy reserves the right to suspend such multiple accounts without being liable for any compensation where you have created multiple accounts on the Platform.
You agree to provide accurate, current and complete information during the registration process and update such information to keep it accurate, current and complete.
You are responsible for safeguarding your password. You agree that you will not disclose your password to any third party and that you will take sole responsibility for any activities or actions under your Truckinzy Account, whether or not you have authorized such activities or actions. You will immediately notify us of any unauthorized use of your Truckinzy Account.
Personal Information: Users will be required to share certain personal information with Truckinzy including but not limited to their name, phone number, email address in order to avail the Truck Services and the User hereby permits Truckinzy to share such personal information with the Truck Owners for confirming such User's booking .Truckinzy will use these details in accordance with the Privacy Policy published here.
Technical Requirements: Use of the Truckinzy Services requires Internet access through your mobile device. You are responsible for all mobile carrier data or text message charges resulting from your use of the Truckinzy Services, including from any notifications provided by the Truckinzy Services. In order to use the text message based services, you must maintain an active account with a carrier of electronic communications through mobile devices and you may not use a prepaid cellular phone to access such text message services. Truckinzy does not guarantee that the Truckinzy Services will be compatible with all devices or will be supported by all mobile carriers.
Modifications of Truckinzy Services : Truckinzy reserves the right, in its sole discretion, to modify the Truckinzy Services from time to time and without notice, including, without limitation, by removing, adding, or modifying portions of the Truckinzy Services or these T&C . Truckinzy shall have no liability to you for any of the foregoing actions. If you object to any such changes, your sole recourse shall be to cease using the Truckinzy Services. Continued use of the Truckinzy Services following any such changes shall indicate your acknowledgment of such changes and satisfaction with all the Services.
Intellectual Property Rights and Grant of Rights to User: The features, information and materials provided and depicted through the Truckinzy Services are protected by copyright, trademark, patent, and other intellectual property laws. All text, graphical content video, data, and other content made available through the Truckinzy Services (collectively, the Truckinzy Content) are provided to User by Truckinzy or its partners or licensors solely to support User's permitted use of the Truckinzy Services. The Truckinzy Content in the Platform or Truckinzy Services or these T&C may be modified from time to time by Truckinzy in its sole discretion.
Applicability of other Truckinzy Policies: You hereby agree that at all times, this T&C shall be read in conjunction with the other terms and conditions of the Truckinzy Policies.
Termination: Truckinzy may suspend your ability to use all or any element of the Truckinzy Services or may terminate this agreement effective immediately, without notice or explanation. Without limiting the foregoing. Truckinzy may suspend your access to the Dine Out Services if we believe you to be in violation of any part of this T&C (including any Truckinzy Policies). After any suspension or termination, you may or may not be granted permission to use the Truckinzy Services or re-establish an Account. You agree that Truckinzy shall not be liable to you for any suspension or termination of this agreement or for any effects of any termination of this agreement. You are always free to discontinue your use of the Truckinzy Services at any time. You understand that any termination of your Account may involve deletion of any content stored in your Account for which Truckinzy will have no liability whatsoever.
Use License: Permission is granted to temporarily download one copy of the materials (information or software) on TRUCKINZY's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
Modify or copy the materials;
Attempt to decompile or reverse engineer any software contained on TRUCKINZY's website;
Severability: If any of the provisions, or portions thereof, of this Agreement are found to be invalid under any applicable statute or rule of law, then, that provision (or portion thereof) notwithstanding, this Agreement shall remain in full force and effect and such provision or portion thereof shall be deemed omitted.
Assignment: This Agreement and the rights granted and obligations undertaken hereunder may not be transferred, assigned, or delegated in any manner by User, but may be freely transferred, assigned, or delegated by Truckinzy
Waiver: Any waiver of any provision of this Agreement, or a delay by any party in the enforcement of any right hereunder, shall neither be construed as a continuing waiver nor create an expectation of non-enforcement of that or any other provision or right.
Permitted Use: All the users agree to use the data provided for the sole purpose of evaluating and selecting suitable candidates for employment or contracting purposes. Any other use of the data is strictly prohibited.

Security Measures: We employ industry-standard security measures to safeguard the data from unauthorized access, disclosure, alteration, and destruction. However, we cannot guarantee absolute security and users should take necessary precautions to protect their data.
Ownership of Data: Ownership of Data: The ownership of the driver data remains with our company. Truck owners have a limited, non-exclusive right to use the data for the agreed-upon purposes outlined in these terms and conditions.
Duration of Agreement: These terms and conditions are effective upon acceptance by both parties and shall remain in effect until terminated by either party. Termination provisions are outlined in a separate agreement.
No Liability Clause: Our company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use or misuse of the driver data provided to truck owners.
Indemnification: You agree to indemnify and hold harmless Truckinzi and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your use of our services or liabilities arising from their use of the driver data, including but not limited to claims of negligence or breach of contract.
Compliance with Laws: Both parties agree to comply with all applicable laws and regulations related to data protection and privacy, including but not limited to GDPR and any local laws governing the handling of personal data.
Dispute Resolution: Any disputes arising from these terms and conditions shall be resolved through negotiation and mediation in good faith. If mediation fails, the parties agree to submit to the jurisdiction of the courts in [Jurisdiction] for resolution.
General: Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the Platform. Only individuals who are 18 years of age or older may use the Platform and avail Services. If you are under 18 years of age and you wish to download, install, access or use the Platform, your parents or legal guardian must acknowledge and agree to the Terms of Use and Privacy Policy. Should your parents or legal guardian fail to agree or acknowledge the Terms of Use and Truckinzy policies, you shall immediately discontinue its use. Truckinzy reserves the right to terminate your Membership and/or deny access to the platform if it is brought to Truckinzy's notice that you are under the age of 18 years.
If you choose to use the Platform, it shall be your responsibility to treat your user identification code, password and any other piece of information that we may provide, as part of our security procedures, as confidential and not disclose the same to any person or entity other than us. We shall at times and at our sole discretion reserve the right to disable any user identification code or password if you have failed to comply with any of the provisions of these Terms of Use.
As we are providing services in the select cities in India, we have complied with applicable laws of India in making the Platform and its content available to you. In the event the Platform is accessed from outside India it shall be entirely at your risk. We make no representation that the Platform and its contents are available or otherwise suitable for use outside select cities. If you choose to access or use the Platform from or in locations outside select cities, you do so on your own and shall be responsible for the consequences and ensuring compliance of applicable laws, regulations, byelaws, licenses, registrations, permits, authorisations, rules and guidelines.
You shall at all times be responsible for the use of the Services through your computer or mobile device and for bringing these Terms of Use and Truckinzy policies to the attention of all such persons accessing the Platform on your computer or mobile device.
You understand and agree that the use of the Services does not include the provision of a computer or mobile device or other necessary equipment to access it. You also understand and acknowledge that the use of the Platform requires internet connectivity and telecommunication links. You shall bear the costs incurred to access and use the Platform and avail the Services and we shall not, under any circumstances whatsoever, be responsible or liable for such costs.
By using the Platform you represent and warrant that:

Your use of the Platform shall be solely for your personal use and you shall not authorize others to use your account, including your profile or email address and that you are solely responsible for all content published or displayed through your account, including any email messages, and your interactions with other users and you shall abide by all applicable local, state, national and foreign laws, treaties and regulations, including those related to data privacy, international communications and the transmission of technical or personal data.
You will not submit, post, upload, distribute, or otherwise make available or transmit any content that:
(a) is defamatory. abusive, harassing, insulting, threatening, or that could be deemed to be stalking or constitute an invasion of a right of privacy of another person;
(b) is bigoted, hateful, or racially or otherwise offensive:
(c) is violent, vulgar, obscene, pornographic or otherwise sexually explicit:
(d) is illegal or encourages or advocates illegal activity or the discussion of illegal activities with the intent to commit them.
All necessary licenses, consents, permissions and rights are owned by you and there is no need for any payment or permission or authorization required from any other party or entity to use, distribute or otherwise exploit in all manners permitted by these Terms of Use and Privacy Policy, all trademarks, copyrights, patents, trade secrets, privacy and publicity rights and/or other proprietary rights contained in any content that you submit, post, upload, distribute or otherwise transmit or make available.
